The Family Law Act 1975 does not require evidence of what caused a marriage to break down. It is a “no fault” system. The only requirement the Court considers in a divorce application is that there has been an irretrievable breakdown of the marriage.
In cases where there are children under the age of 18 years old, the Court also considers whether proper arrangements have been made for the care of the children. The Court is interested in the practical aspects of the children including who they live with, what time they spend with each of the parties, what child support is being paid, the health and education of the children.
An application for divorce cannot be filed until the parties have separated for 12 months. However parties can still deal with their other aspects of separation including financial settlement, parenting, child support matters following separation.
There are time limits on bringing applications for property and spouse maintenance once divorce is granted.
